Parking Pass Terms and Conditions

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY AS THEY GOVERN YOUR RIGHTS UNDER THE PASS AND CONTAIN BINDING ARBITRATION AND CLASS-ACTION WAIVER PROVISIONS.

Each parking pass you purchase or otherwise receive (a “Pass”) to attend a Kansas City Current home game or other event held at CPKC Stadium (each an “Event”) is a revocable license that allows the bearer (the “Pass Holder”, “you” or “your”) to park one vehicle, as directed, within the designated CPKC Stadium parking lots (the “Stadium Lots”), on the date indicated, for the Event only, subject to the terms and conditions herein.

Any violation of these terms and conditions, including any terms or conditions displayed or accepted in the digital Pass or printed on any physical Pass, will terminate this license which may result in your ejection from the Stadium Lots and surrounding areas, forfeiture and cancellation of your Pass (and, if applicable, season parking Passes), as determined in the sole discretion of KC WFC StadCo Funding, LLC, CPKC Stadium, KC Current, the National Women’s Soccer League (“NWSL”), each of their parent, subsidiary and affiliated companies and their respective employees, owners, agents, partners, staff, shareholders, directors, managers, members, representatives, officers, attorneys, licensors, servants, sponsors, service providers, parking lot operators and assigns (collectively, “Licensor”) without refund, reimbursement, credit, make-good or other compensation, and/or the vehicle being towed at the owner’s expense. Further, if Licensor refuses admission to or ejects Holder from the Stadium Lots or an Event because Holder’s or its guests’ conduct, in Licensor’s sole discretion, violates these Terms, any applicable code of conduct, the policies of the CPKC Stadium, KC Current or NWSL, as applicable, or is otherwise disorderly (or complicit in such conduct), Holder will not be entitled to any refund, credit, makegood or other remedy. Licensor and law enforcement officials reserve the right to control access to any gate and to deny access to any gate or area of the Stadium Lots regardless of the provisions of these Terms.

Bearer and any accompanying minors and/or guests agree that this Pass license is subject to these Parking Pass terms and conditions (“Terms”) and by acceptance or use or both of this Pass for an Event, each is deemed to have read the Terms, understood them, and agreed to be bound by them. Lost or stolen Passes, counterfeit Passes, or Passes sold in violation of any applicable law or Licensor’s policies may not be honored.  Further, this Pass may not be used for, or in connection with, any form of commercial or trade purposes including, but not limited to, any advertising, promotions, contests, sweepstakes, giveaways, gambling or gaming activities, without the express written consent of the Licensor. Use of this Pass in violation of any law is strictly prohibited.

PASS PURCHASE TERMS:

ALL PASS SALES ARE FINAL AND NO REFUNDS, CREDITS, EXCHANGES OR OTHER COMPENSATION WILL BE ISSUED OR PROVIDED EXCEPT AS OTHERWISE PROVIDED FOR IN THESE TERMS AND CONDITIONS.

All Pass prices are exclusive of taxes and other fees that may be assessed at the time of purchase. Passes must be paid for in advance of receiving access to the Stadium Lots to park, and Passes will only be issued/delivered once payment is successfully processed. Licensor reserves the right to revoke or restrict Pass purchases and/or Pass acceptance for any reason in its or their sole discretion. Passes must be purchased in advance and will not be sold on-site (unless otherwise communicated in advance of a specific Event by Licensor).

WITHOUT LIMITING ANY OF THE FOREGOING, YOUR SOLE AND EXCLUSIVE REMEDY IF THIS PASS OR YOUR ADMISSION TO EVENT IS REFUSED OR WITHDRAWN, OR IF THE EVENT IS CANCELLED AND NOT RESCHEDULED, IS A REFUND OF THE FACE VALUE OF THIS PASS FOR SUCH EVENT. LICENSOR’S LIABILITY FOR ANY BREACH OF THESE TERMS SHALL NOT EXCEED FACE VALUE OF THE PASS. IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL, INDIRECT, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND INCLUDING, WITHOUT LIMITATION, ANY AMOUNT PAID IN EXCESS OF THE FACE VALUE FOR THE PASS.

PARKING LOT TERMS:

The Pass must be shown and provided to Licensor, and/or otherwise displayed while on the Stadium Lots, as determined by Licensor. Overnight parking is not permitted for any vehicles. Early admittance is not permitted for any vehicles unless approved by Licensor. All spaces are available on a first come, first served basis. The date and time of any Event (and the opening of the gates) are subject to change in Licensor’s sole discretion or as a result of events beyond their control, and no such change shall entitle Holder to any refund, reimbursement, credit, make-good or other compensation or other remedy if Holder cannot attend the rescheduled Event or for any other reason. 

Passes may be assigned to specific parking zones or lots depending on the Event. The purchase of a pre-paid, season, or day of event Pass allows you to self-park one vehicle in one parking space in the designated parking zone or lot within the Stadium Lots. You must park in the location directed by Licensor’s traffic/parking staff. Saving parking spaces for any reason is strictly prohibited.

If your vehicle exceeds 18’ in length and/or 9’ in width, or if Licensor, in its sole discretion, determines that your vehicle is too large to fit properly into one space, or if it is a bus or RV, you may be refused entry, directed to another parking area, and/or be required to purchase an additional Pass. Tow-behind trailers are not permitted.

Non-licensed motorized vehicles are prohibited within the parking lot(s), including without limitation golf carts, ATV's, UTV's and other similar vehicles.

All vehicles must leave the Stadium Lots no later than 2 hours after the end of the Event. Any vehicle left on the Stadium Lots may be towed off-site at the owner’s expense.

Solicitations, commercial or otherwise, including the use of branded vehicles, are prohibited without Licensor’s prior written approval or other agreement, in all cases at Licensor’s sole discretion. Sales of any food, beverage, or other items at the Stadium Lots, either prepaid or walk-up, is prohibited without Licensor’s prior written approval or other agreement, in all cases in Licensor’s sole discretion. ANY FORM OF TAILGATING AT THE STADIUM LOTS IS PROHIBITED.

All applicable federal, state, and local laws, including those related to use of accessible parking spaces, alcohol consumption and distribution, and all other activities shall apply and will be strictly enforced by police and/or Licensor while you are in the Stadium Lots. Failure to obey any instruction, direction or request of police and/or Licensor’s traffic/parking staff or set forth on Stadium Lot signage shall be deemed a violation of these Terms.

Holder and its guests shall comply with Licensor’s security policies and Code of Conduct and shall not bring any items prohibited by the Parking Lot Rules and Regulations[MW1] . You acknowledge and agree that you and your guests and each of your respective belongings and/or vehicle may be searched upon entry into the Stadium Lots, any Event area(s) and/or other security checkpoints. Prohibited items may be confiscated at the sole discretion of Licensor or individual conducting the inspection. Any surrendered or confiscated prohibited items will be deemed to have been surrendered irrevocably and voluntarily and may be disposed of by Licensor without any liability. Holder hereby consents to such searches and inspections and waives all claims relating to them. If Holder or its guests do not permit such searches or inspections, Holder acknowledges that Licensor has the right to deny entry or to eject Holder and/or its guests from the Parking Lots or Event without refund.

Holder acknowledges that your use of the Stadium Lots and any related activities, including those of other guests in your vehicle and other guests in the Stadium Lots, involve the risk of damage or injury to your vehicle, you or your passengers’ personal property and a risk of personal injury or illness to you or your guests, including bodily injury, illness or death. Licensor (whether acting as bailee or otherwise) is not responsible for and does not assume any liability arising from fire, theft, natural disaster or any other damage to or loss of vehicle or any property of Holder or its guests while in the Stadium Lots. You assume all risks, dangers or other consequences occurring before, during or after your use of this Pass, howsoever caused, including all risks, dangers or other consequences caused by the negligence of Licensor or the negligence or misconduct of any other user of the Stadium Lots, and Holder hereby waives all claims and potential claims relating so such risks, hazards and dangers.

You, on your behalf and on behalf of your guests, and each of your or their respective spouse, family, assigns, guardians, administrators, executors and any other legal representatives hereby releases, waives, discharges, covenants not to sue, and indemnifies Licensor and the Port Authority of Kansas City (the “Licensor Parties”) from any claims (whether alleged, adjudicated or otherwise and including third party claims and claims between the parties), losses, damages, liabilities, deficiencies, actions, judgments, costs, and expenses of whatever kind (including attorneys’ fees), now known or hereafter known, whether arising, directly or indirectly, out of the action, inaction, or negligence of the Licensor Parties, including, without limitation, bodily injury, death or injury to or destruction of property related to Holder’s use of this Pass, entry into, or presence withing or around the Stadium Lots or any interaction between Holder and any third party and/or any personnel of any of the Licensor Parties present at the Event.

Any dispute arising in connection with these Terms shall be resolved by mandatory, confidential, final, and binding arbitration held before a neutral, single arbitrator in Kansas City, MO conducted by the Judicial Arbitration Mediation Services, Inc. in with its Comprehensive Arbitration Rules and Procedures effective June 1, 2021. The costs of such arbitration shall be split evenly among the parties except upon an arbitrator’s finding that such split renders the arbitration cost-prohibitive to the Pass Holder. Any and all issues relating or pertaining to arbitration or this arbitration clause, including but not limited to the threshold question of arbitrability or the enforceability or validity of this arbitration clause shall be delegated exclusively to the arbitrator selected pursuant to this provision. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction. HOLDER AGREES THAT ALL DISPUTES SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS AND WAIVES ANY RIGHT TO LITIGATE IN COURT OR ARBITRATE ANY CLAIM AS A CLASS ACTION, REPRESENTATIVE ACTION, OR CLASS ARBITRATION. IF HOLDER DOES NOT CONSENT TO THIS CLAUSE, HOLDER MUST IMMEDIATELY LEAVE OR NOT ENTER THE STADIUM LOTS. All claims, judgments, and awards shall be limited to the amounts and remedies listed above.

Other than any terms applicable to the purchase or acquisition of a Pass, such as, by way of example, SeatGeek’s terms and conditions, these Terms are the entire understanding and agreement between the parties with regard to the purchase of a Pass. The provisions of this Agreement are severable, and the invalidity of one or more provisions herein shall not have any effect on the validity or enforcement of any other provision. The title of the sections, headings and subsections of this Agreement are for convenience only and do no define or limit the contents.

Any failure to enforce, or variance in a particular case, of any one or more terms of these terms and conditions, or any policies or regulations of Licensor, shall not serve as a waiver with respect to any such terms, conditions, policies or regulations for any future cases or other Passes. Nothing contained herein shall be construed to create any duty or obligation of Licensor to create, enforce, guarantee, or monitor any regulations, policies, procedures, or situation related to the Pass or its use at the Stadium Lots.

These Terms shall be governed exclusively by the provisions hereof and by the laws of the state of Missouri and is intended to be as broad and inclusive as permitted by such laws, without giving effect to any choice of laws or conflict of law rules (whether of Missouri or any other jurisdiction) which would limit the application of the laws or of the jurisdiction of the laws of the state of Missouri.

Licensor may amend or supplement these Terms, and any policies related to access to and use of the Stadium Lots and/or CPKC Stadium, as it deems necessary on an on-going basis. By accepting and/or using a Pass, Holder agrees to the then-current applicable terms, conditions and policies.

All use of the parking lots at the Stadium Lots shall be subject to limitations, regulations, and restrictions set forth at http://www.com/stadium/parkinglotpolicies.
